Hearing in trademark can be of various types, Hearing for trademark objection termed as Show cause hearing, hearing for Trademark Opposition, hearing for Trademark Rectification and hearing for Review petition etc.
In the matter of trademark objection hearing comes into picture when there are certain objections raised in the examination report and Registrar is not satisfied with the reply so filed in response of objection raised or he needs more evidences or it’s necessary to do so; calls upon the Applicant or the trademark agent / trademark attorney to attend the hearing. This would be given in the form of a Show Cause hearing notice to the applicant or his agent.
Trademark opposition hearing is governed under rule 50 of the trademark rules 2017. The registrar after closer of the evidences shall give notice of hearing to the parties / agent.
These hearings need to be attended on the place, date and time fixed in the notice, failing in which may lead the trademark to be abandonment.
